At The Daily Pilates LLC, we respect your privacy. We have created this privacy policy (the “Privacy Policy”) to demonstrate our commitment to fair information practices and the protection of your personal information that we and our affiliates collect from you or that our third-party franchisees collect from you and provide to us for storage or processing.  Information may be collected from you through our website, mobile app, The Daily Pilates Studios (“Studios”), social media accounts, communications with us, and other online and offline offerings (collectively, the “Services”) and is provided to us or stored on a common database that we control.  The Daily Pilates system is a franchised system, with each Studio being owned either by us, our affiliate, or a third-party franchisee to whom we have granted a license to operate as part of our system. Each franchised Studio is owned by a separate legal entity. This Privacy Policy is only applicable to personal information that, in each case, is stored on the common software that we control and maintain (“Our Systems”) or that is otherwise in our possession and control. It does not apply to any personal information you provide directly to a Studio third-party franchisee if that information is not then provided to us or stored on Our Systems. This Privacy Policy also does not apply to third-party products, services or websites you may be able to access via the Services. Since they are owned by third parties, we do not control them, and their practices and policies regarding how they collect, store and use information you provide to them may differ materially from this Privacy Policy. We encourage you to review their privacy policies before providing them your personal information. 


For purposes of this Privacy Policy, the term “personal information” has the same meaning as the equivalent term defined under applicable laws and does not include certain types of information, such as information that is publicly available or de-identified. 


By using our Services, you agree to the collection and use of your personal information in accordance with this Privacy Policy.


Types of Information Collected


Information Received Directly from You


Your personal information may be collected from you directly when you complete forms, register for memberships, purchase any Services, sign up to receive emails or text messages, contact us, make payments, visit our website, use our mobile application, or visit Studios. This information may include your name, date of birth, gender, e-mail address, social media handles, phone number, physical address, payment information, and related information (including any information you voluntarily provide to us, such as any health or medical conditions you may disclose to us as part of your participation in the Services or when you are cancelling your membership). We may also collect information from your registration or attendance at any of our promotional events outside of the Studios or when you interact with any franchised or company-owned Studios.


Information Received from Third-Party Sources


Your personal information may be collected when you interact with us on any social media platforms or online advertising networks. This also includes information from third-party booking platforms, such as MindBody, through which you provide your name, contact information, and intake forms and waivers. Our website and mobile app may also allow you to register with, log on to, or enhance the profile you create on our website by choosing to automatically populate the requested data fields with information you previously provided to a third-party social media platform (such as Facebook, Instagram, or Twitter). By doing this, you are giving permission for the third-party platform to send us information and for us to collect that information from them, including personal information from your profile on that platform, such as your name, e-mail address, and social media handles, among other information


Information Collected Automatically


Your personal information may be collected via anonymous identifiers such as cookies and other technologies used by service providers to collect and store certain types of information whenever you interact with us or third parties that use our Services. The information we collect automatically from you typically includes your IP address, the name of your operating system, the name and version of your browser, the date and time of your visit, and the pages you visit. The information we receive may depend on your browser or device settings. We may associate this data with personal information we collect in other ways in order to improve our website and deliver a better customer experience, including by storing your account information and preferences, speeding up your searches, estimating our audience and its usage patterns, and recognizing returning visitors to the website.


Some content or applications on the website are served by third parties, including advertisers, content providers and application providers. These third parties may use cookies (alone or in conjunction with other tracking technologies) to collect information about you when you use our website. The information collected may be associated with your personal information, or they may collect information, including personal information, about your online activities over time and across different websites and other online services. They may use this information to provide you with internet-based (behavioral) advertising and other targeted content.


We do not control these third parties’ tracking technologies or how they might be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.


Children


You must be at least 16 years old to have our permission to use our website, mobile app, or Services. We do not knowingly collect, use or disclose personal information about visitors under 16 years of age. If you are under the age of 16, you can use our website, mobile app, or other offerings only in conjunction with your parent’s or guardian’s permission. How We Use Your Personal Information


We may use the personal information we collect from and about you for any of the following purposes: 

  • To provide you with Services in Studios, via the website, and through the mobile application

  • To respond to your requests and inquiries and provide you with information you request

  • To evaluate or process employment applications

  • To establish, manage, and administer membership accounts

  • To process payments for purchased Services

  • To improve the membership and customer experience, including the functionality of the Services

  • To market Services and special offers to you (in accordance with any privacy preferences set) 

  • To ensure that Studio operations are efficient and appropriately conducted

  • For security or fraud prevention purposes, or to fulfill a request by a government agency

  • For any other legitimate business interest we disclose to you

  • For any other purpose you consent to or direct us to


To Whom We Disclose Your Personal Information


We do not sell, share, or otherwise disclose personal information about you except as described in this Privacy Policy. Please note that some state-specific statutes may define a “sale” to include sharing of personal information with third parties for valuable consideration. Like many other companies, we have common arrangements with online advertising networks and analytics companies that may potentially be considered sales under these definitions.  Please reference our additional notices under “State-Specific Privacy Rights,” below.


In some circumstances, we may describe additional ways that your information will be disclosed at the time we collect the information from you. We may also disclose information where you direct us to disclose the information, or as you otherwise consent to at the time we collect the information from you.


The Daily Pilates Corporate & Instructors


The information we collect from our website about you will be disclosed or accessible to our corporate employees and instructors and employees of Studios owned by us or our affiliates.


Our Franchisees


We share some personal information with our third-party franchisees that operate most of the Studios you visit. The personal information shared with franchisees is typically related to membership account and payment processing information. We share this personal information to make sure you have a seamless experience whether you visit a corporate-owned or franchise-owned Studio.


Our Vendors


We work alongside many vendors who help us to provide the Services, from payment processing and class booking platforms to marketing and communications services and technology support. When reasonably necessary, we share your personal information to help our vendors perform the Services that we ask them to do, so the types of personal information shared will vary with the role of the vendor. When we share personal information, our vendors are required to use it according to their contractual obligations and their terms, conditions, and privacy policies.


To Comply With Laws


We may disclose your information when we, in good faith, believe disclosure is appropriate to comply with the law, a court order or a subpoena. We may also disclose your information to prevent or investigate a possible crime, such as fraud or identity theft; to protect the security of the Services; or to protect our own rights or property or the rights, property or safety of our users or others.


Business Transactions


We may share any personal information as needed if we engage in a sale, merger, transfer of our business, or other transaction regarding our assets, including for the negotiation of any such transaction. 


Notice of Financial Incentive


If you have a membership with us, we may provide certain discounts, special offers, benefits, or other rewards as part of your membership, which may be interpreted as a “financial incentive” or “bona fide loyalty program” under certain applicable laws, when we collect your personal information, which may include your name, contact information, address, or birthday. Creating a membership with us is subject to your opt-in consent. The value of your personal information may vary depending on the types of special offers, benefits, or other rewards that are available and you choose to participate in, and it is reasonably related to the incentives that we offer. You may withdraw from a financial incentive at any time by contacting us as described below.


Retention & Security of Your Personal Information


We retain your personal information for as long as is reasonably necessary to fulfill the purpose(s) for which it was collected or as otherwise required to be retained under applicable law. We will retain all information collected for so long as you have a membership account with us, so that we can provide you with Services efficiently and thoroughly.  Should you request to deactivate your membership account or for us to erase your personally identifiable data, following a transition period (up to 30 days), we will cease to retain all personally identifiable information you have provided.  However, retention periods may be extended if we are required to preserve your information or data because of litigation, investigations and other similar proceedings, or if a longer retention period is required or permitted by applicable law. 


We use reasonable security measures that are designed to protect your personal information; however, no system of transmission or storage of data can be 100% secure. We cannot guarantee the absolute security of your information, and we are not responsible for any circumvention of any privacy settings or security measures contained on the website. The safety and security of your personal information also depends on you. where we have given you (or where you have chosen) a password to access or use certain parts of our website, you are responsible for keeping that password confidential.


Your Privacy Rights


Depending on applicable laws or the jurisdiction you reside in, you may have certain rights regarding your personal information, which may include the right to:


  • Access, know about, or confirm that your personal information is being processed, including the categories of personal information processed, the sources from which the personal information is collected, the purpose(s) for collection, the sale or sharing of personal information, and the categories of third parties with whom personal information is shared or sold.

  • Correct inaccuracies in the personal information we collect or maintain about you

  • Delete your personal information

  • Opt-out of the sale, sharing, or use of personal information, including for targeted advertising (as all terms are defined under the privacy laws applicable to you)

  • Appeal any decision made by us with regard to your exercise of your privacy rights

  • Request and receive your personal information


The exact scope of these rights may vary by state. Our ability to comply with your request to exercise your rights may be limited in situations where, under applicable law, such information must be maintained to comply with a legal obligation. To exercise any of these rights, please see the “Contact Us” section, below. If you choose to exercise any of your privacy rights, we will not discriminate against you.


Opt-Out


You may opt-out of receiving communications from us by contacting us as provided at the bottom of this Privacy Policy, or by following the “unsubscribe” link or instructions provided in the communications we send.


Tracking Technologies


Visitors who do not wish to have cookies placed on their computers should set their browsers to refuse cookies before using our website or mobile apps. By continuing to navigate our websites and mobile apps without changing your cookie setting, you are acknowledging and agreeing to our use of cookies. If you do not accept cookies, you may not be able to use some features of our Service and we recommend that you leave them turned on.


How to Exercise Your Privacy Rights


We use commercially reasonable efforts to verify your identity after you submit a request by comparing details provided in your request with personal information in our systems. We may ask you to provide more information to help confirm your identity before your request can be processed. If someone else submits a request for you, we may still ask you to verify your identity or confirm the request. If we cannot confirm your request or your identity, we may not be able to act on your request. Making a verifiable consumer request does not require you to create an account with us.


State-Specific Privacy Rights


For Residents of California


Under certain provisions of the California Civil Code, residents of California have the right to request a list of all third parties to which the company has disclosed certain personal information (as defined under California law) during the preceding year for direct marketing purposes. You are limited to one request per calendar year. In your request, please note that you are a California resident and provide a current California address for our response. 


California residents also have the following rights with regard to our use of their personal information:


  • Right to Access and Right to Know: you have the right to request that we disclose the following to you

    • the categories of personal information we have collected about you;

  • the categories of sources from which the personal information is collected;

  • our business or commercial purpose for collecting or selling personal information; 

  • the categories of third parties with whom we share personal information; and

  • the specific pieces of information we have collected about you. 

  • the categories of personal information about you, if any, that we have disclosed for monetary or other valuable consideration and the categories of third parties to which we have disclosed the information, by category or categories of personal information for each third party to which we disclosed the personal information; and

  • the categories of personal information about you that we disclosed for a business purpose.

  • Right to Deletion of Personal Information: you have the right to request that we delete personal information about you that we have collected from you. 

  • Right to Correct. You have the right to request that we correct personal information that we maintain about you that is inaccurate.

  • Right to Opt-Out of Sale or Sharing: Despite the fact that we do not sell your personal information and we have no plans to do so, you have the right to opt out of the disclosure of personal information about you for consideration and the sharing of your personal information for cross-context behavioral advertising. You may submit an online request to opt-out of the sale or sharing of your personal information by using a contact method described at the bottom of this Privacy Policy. 


Additionally, we will process opt-out requests submitted by a consumer’s opt-out preference signal as required by applicable law.  You can learn how to set up and use an opt-out preference signal by visiting the California Attorney General’s CCPA page, and consulting the section titled “Requests not to Sell Personal Information (Right to Opt-Out of Sale).”  You can also consult information published by the California Privacy Protection Agency (CPPA) about how you can set up and use opt-out preference signals.


If you are a registered user of the Services under the age of 18, and we have actual knowledge of your age, then under California law you may request and obtain removal of certain content or information you have posted on our online Services. To do so, please contact us using a method provided at the bottom of this Privacy Policy. Please note that removal of certain content or information does not ensure complete or comprehensive removal of the content. For example, removal may not be possible or permitted if another provision of law requires the content to be maintained, if it was posted or reposted by others, or if we paid compensation to you in exchange for the posting.


The personal information we have collected about California consumers in the 12 months preceding the “Last Updated” date of this Privacy Policy are described in the “Types of Information We Collect” section of this Privacy Policy, above. We use such personal information for the business purposes described in the  “How We Use Your Personal Information” section of this Privacy Policy, above.


We may require you or your authorized representative to verify your request by providing us with additional information, including providing us with information to verify your identity before disclosing any personal information to you. This is a security measure to ensure that personal information is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response. You do not need to create an account with us to submit a request to access or erase your personal information.


For Residents of Connecticut, Colorado, Nevada, Texas, Utah, and Virginia


Clients who reside in states in which state-level consumer privacy laws have been enacted may have additional rights regarding our use of their personal information. These residents may be able to exercise rights regarding the access, correction, deletion, processing, storage, portability, transfer, and restriction of personal information, including the right to:


  • request access to your personal information;

  • request erasure of your personal information; and

  • opt-out of the sale or disclosure to third parties.


Nevada law allows consumers to direct certain businesses not to sell their personally identifiable information to third parties to license or sell that information to additional third parties. We do not sell your information to such data resellers and have no plans to do so. Nonetheless, if you are a Nevada resident, you may submit such opt-out requests using any of the contact methods at the bottom of this Privacy Policy.  Please include your full name, address, phone number, and email address. We will try to respond to all legitimate requests within 60 days of receiving the request. Occasionally it could take us longer than 60 days if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.

Exercising Your State-Specific Rights


To exercise any of these rights, you may contact us via any method provided at the bottom of this Privacy Policy. We may require you or your authorized representative to verify your request by providing us with additional information, including providing us with information to verify your identity before disclosing any personal information to you. This is a security measure to ensure that personal information is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response. You may only submit a request to access your personal information twice within a 12-month period. You do not need to create an account with us to submit a request to access or erase your personal information.


We try to respond to all legitimate requests within 45 days. Occasionally it could take us longer than 45 days if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated. We do not charge a fee to process or respond to your request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request. If we refuse to process your request for any reason, you may appeal our decision by writing to us. We will respond to your appeal, disclosing any actions (or inactions) taken in response to the appeal and an explanation for the decisions.


We will not discriminate against you for exercising any of your rights under any applicable state laws. Unless permitted by the applicable state law(s), we will not: (i) deny you any Services; (ii) charge you different prices or rates for Services, including through granting discounts or other benefits, or imposing penalties; (iii) provide you a different level or quality of Services; or (iv) suggest that you may receive a different price or rate for Services or a different level or quality of Services. However, we may offer you certain financial incentives permitted by the applicable state laws that can result in different prices, rates, or quality levels. Any financial incentive we offer that is permitted under the applicable state laws will reasonably relate to your personal information’s value and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior opt-in consent, which you may revoke at any time.


During the preceding 12 months, we have collected each of the categories of personal information we describe in this Privacy Policy, but we have not sold personal information to third parties. 


Transfer of Personal Information


We are located in the United States. You understand and agree that personal information that you provide to us, or which we collect about you may be transferred to, or processed or stored in, the United States, which may not provide the same level of protection to such information as that of your country of residency.


Changes to This Privacy Policy


We may revise or update this Privacy Policy from time to time, including as required under applicable privacy laws or to incorporate changes to our privacy practices. Updates to this Privacy Policy will be reflected in the “last updated” date above, and you should check this Privacy Policy periodically. Your continued use of the Service after we post any modifications to the Privacy Policy on this page will constitute your acknowledgment of the modifications and your consent to abide and be bound by the modified Privacy Policy.
